Factual summary

Applies the reverse charge to supplies between registrants of precious metals (gold, silver, palladium, platinum), precious stones (including diamonds and pearls) and jewellery whose precious content outweighs its other components, where the recipient intends to resell them or use them in production or manufacturing. The recipient accounts for the VAT; the supplier does not. Written declarations of intended use and registration must be given before the supply, and zero-rated supplies are outside the mechanism. It replaced the 2018 gold and diamonds decision.

What it means in practice Professional insight

Who: bullion dealers, jewellers, refiners and gem traders. What to check: whether each supply falls within the defined Goods, declarations held before the supply, registration checks on buyers, and correct reporting of reverse-charged tax by the recipient.

Key provisions

  • Art. 1 Goods: Precious Metals (gold, silver, palladium, platinum), Precious Stones (natural and manufactured (synthetic) diamonds, pearls, rubies, sapphires, emeralds) and jewellery made of them, provided their value exceeds the value of the other components.
  • Art. 2(1) Where Goods are supplied to a registered recipient who intends to resell them or use them in producing or manufacturing Goods, the supplier does not account for the Tax or report it; the recipient accounts for the Tax on the value of the Goods and bears all resulting Tax obligations.
  • Art. 2(2) Does not apply where the supply is zero-rated under Article 45(1) of the VAT Law.
  • Art. 2(3)–(4) Before the date of supply the recipient gives written declarations of the intended use and of his registration; the supplier keeps them and verifies registration by FTA-approved means. Without the declarations the mechanism does not apply and the recipient may not treat the Goods as used for the cases in Article 54(1)(a) and (b) of the VAT Law.
  • Art. 4 Repeals Cabinet Decision No. 25 of 2018 on the Mechanism of Applying Value Added Tax on Gold and Diamonds Between Registrants in the State, and any conflicting provision.
  • Art. 5 Effective 60 days after publication in the Official Gazette (26 February 2025 per the cover).
